Terms of Service – OrderCraft

1. Acceptance of Terms

By accessing or using OrderCraft services, you agree to these Terms of Service in full. If you do not agree, you must not use the platform.

2. Authorized Use

• Services may only be used by registered restaurants that provide legitimate restaurant services.
• Modification, copying, distribution, or alteration of the software or any content is prohibited.
• Support requests must be submitted exclusively through official channels.
• You must not publish or use the platform to distribute illegal, offensive, or inappropriate material, nor to create fictitious, misleading, or deceptive offers, menus, promotions, or advertisements.

3. User Responsibility

• Restaurants are responsible for the accuracy of all data entered, including pricing, taxes, discounts, promotions, and offered products or services.
• Reports provided by OrderCraft are for informational purposes only and do not constitute legal or fiscal guarantees.
• Compliance with tax and accounting obligations is the exclusive responsibility of the restaurant.

4. Intellectual Property

• All intellectual property rights in the platform, software, and content belong to DataCraft Coders.
• Reproduction, modification, or distribution without express authorization is prohibited.

5. Promotions, Pricing and Content Responsibility

• You are solely responsible for all promotions, discounts, prices, service charges, fees, and any commercial conditions configured or published through your OrderCraft account.
• OrderCraft and DataCraft Coders are not responsible for incorrect, outdated, misleading, or misconfigured promotions or prices entered into the platform, including but not limited to discount values, menu prices, currencies, or promotional conditions.
• It is your responsibility to review and verify all promotions and prices before making them available to customers, including test orders and previews where applicable.

6. Tax Information and Reports

• Any tax-related tools, calculations, or reports generated by OrderCraft are provided solely as informational and operational aids based on the data you enter in the system.
• These tools and reports do not constitute official tax, accounting, or fiscal documentation and may not meet the formal requirements of tax authorities or accounting standards.
• You must always rely on a qualified accountant or tax professional to review, validate, and submit any official tax or accounting information, and to confirm that the amounts of taxes and fees are correct.
• OrderCraft and DataCraft Coders are not responsible for penalties, fines, audits, or discrepancies arising from incorrect configuration of tax rates, tax profiles, or reliance solely on the platform's tax-related reports.

7. Limitation of Liability

• OrderCraft is not responsible for any losses, damages, errors, service interruptions, fiscal issues, incorrect promotions or prices, tax miscalculations, or audits arising from platform use or from the information you configure in your account.
• Continuous availability of the system and error-free operation are not guaranteed.

8. Account Suspension and Termination

• The Company may suspend or terminate accounts at any time, without refund, if it reasonably suspects misuse of the platform, publication of inappropriate or illegal material, fictitious or misleading offers or promotions, fraud, violation of these Terms, or complaints from dissatisfied customers.
• In the event of non-payment or failed payment for any subscription or plan, your account may be placed in a suspended status. During suspension, access to the platform and/or specific modules may be limited or blocked.
• If the outstanding payment is not resolved within three (3) calendar days from the start of the suspension, the Company may permanently terminate your account. Upon termination due to non-payment, all information and data stored in your account (including orders, customers, menu configurations, media, and settings) may be irreversibly deleted and cannot be recovered.
• Suspension or termination decisions are final and do not require further justification, although the Company may provide a brief explanation when operationally feasible.

9. Payments and Billing

• All payments are processed via PayPal or other payment providers indicated on the platform.
• Plan changes and cancellations are governed by the subscription policy specified on the platform.

10. Governing Law and Jurisdiction

These Terms are governed by the laws of Guatemala. Any disputes shall be submitted to the competent courts of Guatemala.

11. Changes to the Terms

OrderCraft reserves the right to modify these Terms at any time. Modifications become effective upon posting on the platform.
